problems with rear hatch

anyone else have problems with rear hatch..ours pops open on its own at times or wont open at all..dealership has replaced latch and harness but still doing it..
 
The hatch opens by itself if you stand by it for 3 seconds...
 
So far mine is not a problem but hearing it open sounds identical to my 2013 explorer that had 90k of opens and closes, which scares me.
