I found something from an unofficial source that matches what you’re saying, but no official documentation.

Does a New Car from Out of State Need a CA Smog Check?

(RESOLVED - Click To View) I bought a new car from out of state. It has less than 7500 miles on the odometer AND it meets the 50 state emissions (including California). Do I still need to get a California smog check? I'm a resident of California and will be needing to register it here.

Since this makes no logical sense for anyone involved (the state and local government make no more money in taxes and registration fees and the air/environment is not being protected by doing a test on a brand new vehicle with the same emissions system it would have had if a California dealer sold it), the only way this could have been written into some law would be if a California dealer association lobbied for it to discourage people buying out of state.
The extra hoop of having to drive the vehicle 200 miles plus make a stop at a smog test station and pay for the certificate before registration would be a deterrent for many buyers.

The first thing that link says is:
“A nonresident vehicle is a vehicle last registered in another state or country”

These are brand new cars being first registered to a California resident.
The first owner is registered in California. Only the point of sale is in another state.

The scenario in your link is for used cars that had previously been registered in another state.
These cars were never registered anywhere else.

First, great you read the information from the link.

Second, yes brand new cars. You missed an important detail. When the car is bought out of State it is registered in the State it was purchased. The car is called a nonresidential vehicle. The term has to do with where the car is from not the owner. I think this is what is confusing you.

Ummm, interesting conspiracy theory… you know there are vehicles that are sold in other States that are not California SMOG compliant? A sticker is attached to the engine compartment that states if it is 50 State compliant but would you trust just a sticker on a new car showing up from another State? No that is why they have you SMOG test the nonresident vehicle (any vehicle that has been bought and registered in another State).

It’s not about “trusting a sticker.”
Its a car with a verifiable VIN that can be traced. There are records of which vehicles are 50 state compliant and which are not. A smog test is not required to determine that.
It’s easy to tell if any specific vehicle is 50 state compliant or not and that can be fully automated with a VIN check.

I am not blasting any person on the forum.

Whenever I purchase a vehicle, it is registered in my home address county and city and any DMV fees and sales tax is based on where I live; not where the dealership is located.
If you never lived in the state where the dealership exists, the vehicle would have never been registered there,

Jaxn1, the reality is that DMV requires a SMOG cert. No one here is getting a title and registration for an out-of-state dealer new car without a SMOG cert. It doesn't matter that the vehicle is 50 state compliance. This is not an isolated one-off but standard procedure across the board. For the Telluride, my dealer handled registration for me through a third-party. The third-party's necessary documents: SMOG cert. and a VIN verification.

A new car from an out-of-state dealer is treated differently than a new car from an in-state dealer. All vehicles coming from out of state should be coming with temporary registrations from the dealer's state. Additionally, DMV considers all new vehicles shipped into California as out-of-state vehicles entering the state for initial registration. In combination, you're looking at Health and Safety Code § 44011(a)(4)(C)(ii) applying. Even if you were to ask for no temporary registration (meaning you cannot drive that car on a public surface), the staff level person at DMV isn't going to read 44011(a)(4)(C)(ii) and skip his checklist of documents for you.

Regarding the dealers having a strong lobby to push for protectionism, that is exactly it. If you aren't aware, the dealer lobby is very strong. The laws concerning dealers' rights are arcane and heavily favor local dealers.

I made a short road trip back from i25 Kia back to Bay Area over the weekend and registered today, so sharing my experience for those thinking about driving back from Colorado. Details on the timeline of purchase can be found in my signature.

• i80 route was very clear as of early December (no snow/no crazy wind). Apparently record warm day(s) in Colorado.
• I stayed overnight near Denver International Airport after taking a red-eye, got a Lyft to the dealership the next morning (arranged by them; thank you Carlos), and just picked up the keys (all documentations were completed over email/Zoom/mail).
• Drove to SLC/Wendover the first day, and from there directly to Bay Area.
• Total 19 hours drive (clocked in about ~1300 mi).
  • This is with keeping below 3000rpm in mind for break-in period. Average MPG for the whole trip was around 25.5.
• Shout out to Waltzing Kangaroo in Fort Collins, CO for their delicious Aussie pastries. Also Costco in Fort Collins, CO had some pretty good wine selection if anyone is interested. The huge Costco in SLC was pretty interesting to walk around as well.

Downside from the drive was that I got a small chip on the windshield from all the trucks passing through i80. Also, a bit of bugs and pebbles entered the AC/radiator area so I'd need to figure out protection there for future.

The overall process was really smooth purchasing out of state. I wrote in another thread (Registering in CA) about my registration experience since I had some time in between my actual purchase and pick up. Let me know if there's any question I can help answer.I

Hi there sorry for the late response. I'm really liking the dune brown interior with the gravity gray! I think it really brightens up the interior while not having the risk of stains/dirt easily showing up with the gray interior.

There are currently no dealers in CA selling at MSRP. Hilltop and, I believe, Salinas used to. That's why residents are buying out of state.

None in socal would allow me to do this. When they can mark up to 17k over MSRP and practically sell the car the day it arrives on the lot they wouldn’t even think about doing this.

My car has arrived in i25 Kia and we are going through the financing process.

The shipping of the car that the dealer quoted was 1500 for open and round 1800+ for enclosed.
I am trying to find other companies that would deliver the car.
What are some of the recommendations that you guys have used.?

In the meantime the dealer has sent me some pics and it seems that there is some dust on carpet and se mud on the side. The dealer is in Colorado. It has 10 miles in odometer. The dealer said it's not washed yet but my question is it normal for the car to look a little used when it arrives at the dealership.

Is that normal tho? Its sitting in the dealer and will get shipped to Cali once paperwork is done. It's possible the dealer must've taken it to test drive.. lol but a truck driver.

The dealer said it's not washed yet but my question is it normal for the car to look a little used when it arrives at the dealership.

They have to get it off the trailer, so they could have had dirty shoes when they got it in to move it to wear its being held. Possibly ran it to the gas station to fill up, maybe they hold their vehicles at an offsite location. I'm sure the vehicle will be detailed as well. I'd just kindly request that.
