The general amount they write off daily is $2,500 USD...you can get more if you work with a lawyer.

However, you have to waive the RIGHT to bring suit against them ever again...tough pill to swallow if you ask me.

I’m don’t have a lawsuit against Kia but I did have my power steering motor fail before 1500km. The car was with the dealership for 2 months. It had also just been ceramic coated before it broke and knowing it would take a while, I asked Kia to tow it back to my house but they denied that claim. I ended up sending my own tow truck.

Once the car got fixed I asked for compensation. This included the fact that I was paying for a car bi weekly and not having it, the depreciation, the concern of power steering failing so early.... etc.

They just flat out declined it without a real explanation except that these things are mentioned in the Kia agreement and they don’t take responsibility for a vehicle breaking, apart from the fact that they will fix it.

I like the car, and I have another Kia as well, but things like this is how you lose customers. I get all manufactures suck in their own way, but I guess I’ll be seeing how badly someone else sucks next time I buy a new car lol.

The new car has significant production defects allowed during assembly and the quality department also ignored them. In my opinion, due to the high demand, they just ignored and sent the car to the customer:

• The ventilation plastic cover on the dashboard has a defect in the casting of a part.
• 
  
• The leather armrest on the driver’s side has a material crack in the corner.
• 
  
• Both C-pills have scratches and dents.
• 
  
• Headliner:
• In the area of the front sunroof there is a large spot of glue that has come through the fabric material.
• On the right side back area has a crease pf material and a shaggy edge.
• 
  
• Rear left door:
• Poorly painted under the sealing rubber.
• The edge of the door at the sealant is poorly painted, air bubbled ad a slight swelling of paint.
• 
  
• Rear left fender:
• Large foreign blotch on the edge, like paint drips or the sealant.
• The inner side is poorly painted, paint cracks.
• 
  
• Around the 30th of September, an additional defect in the painting and measured of the front bumper appeared. The bumper was not properly measured (no fixed gap), the corners of the bumper pushed against the headlight and that has caused paint polish pealing to the plastic of the module being caused by vibrations o the moving vehicle on the day to day basis of the vehicles exploitation.

The dealer's technicians and Kia Canada (conducted a 2-month investigation) and recognized all claims as valid and warranted.

For 2 months I tried to contact Kia Motors Manufacturing Georgia and with the executive director of product quality Julie Kurcz for resolvent of the problem.
No answer was heard.
They just ignore - which is normal on the Kia side, just ignore the customer and the problem.

Has filed an application to the court, KMMG has already received a notification.

A little later I will publish in this thread, for general review, the statement of claim.

And of course, as soon as KMMG sends the defense notes, I will publish it here.

PS - I know a couple of our members of the forum who are also in litigation with Kia America, I propose to tell in this thread how your process is going and of course publish the defense notices from Kia - I think many will be interested in how Kia is trying to get out.

It’s easy to get on someone for complaining too much, I thought the same. Then my car broke down and took 2 months for repair and dealing with Kia is like talking to a brick wall.

Just be glad you have no issues and so you don’t have to come over to the dark side lol. It changes you quickly.

I don’t think there is a lemon law. My car isn’t a lemon though... the power steering motor broke and it was replaced and all is good again. I was simply challenging them for the fact that it broke so soon, and that it took 2 months for the part to arrive.

they just flat out refused.. and it’s not a big deal.. I was hoping to get some comp out of it, but it’s not like it’s keeping me up at night.

I just won’t buy another Kia and see if I have a better experience with other manufacturers (LOL).

We don't have a lemon law, but we do have liability for negligence and misleading. Let's see what the Kia will do now, I hope now they will go into dialogue.
There are only 2 options:
1- kia will contact me and we will decide,
2- they will send a defense notices, but to be honest, have to be a complete to do this, since what write something there ....
Let's wait, see, I'll keep you in course.

More than 50% of Kia's allotted response time has passed. They have not yet provided defense notice. They never contacted me, although last week I sent them a letter again and called. Complete silence.
Okay, I'm waiting, just a little bit remains.
As soon as the deadline has passed, I will publish here the text of my statement and if there is a response from Kia.
By the way, as soon as there is an answer and / or the deadline has passed, one of the major news channels will be ready to make an article on my case. I have already sent them an application, photos, in short they were interested and everything was agreed, but I need a response from Kia and / or an expired date - a highlight, so to speak.

Wish you the best for your issues...I agree Kia dealer and corporate support is hit and miss for QC issues. I have seen glue marks on the ceiling material and unacceptable panel gaps as well.

Kia definitely needs to step up their level of support for these issues.

Best advise I can offer to all is to very thoroughly inspect your new car before signing the paper work and taking possession at the dealership. If you find something wrong you can have it addressed prior to taking it home or at the minimum have the dealer acknowledge it in writing to be addressed or be compensated for with some sort of incentive.

@Kwim - my counsel basically said Kia will usually not offer a buyback unless there is a major issue or safety concern. Unfortunately I don't see them offering to buy your vehicle back.

What I believe may happen is they offer you compensation...or...offer you nothing. In the latter case I believe you can make it a BBB case which will be binding arbitration.

The test drive is most important. Get it on a highway and test the full range of MPHs/RPMs.

When numerous is let's say between 1-2% of all vehicles manufactured then it would not garner much attention.

Things I noticed after delivery:
uneven hood panel gap
rear door window trim not flush with rear quarter panel trim
fuel cap cover not flush
glue marks on ceiling panel
collapsed seat foam

Not sure if other members could add to the checklist.

So I finally got my Telluride and I spent a solid hour at the dealership inspecting it inside and out. There were a few minor imperfections but within the range of reason as this is a mass production car and you have to be realistic. A few days after having it the edge of the rear door trim began to pull apart. It's very minor but I know if not properly glued back on will get worse. I am debating taking back to the dealer or just applying the glue myself and placing a clamp on it. The only reason I thought about managing it myself is because I know my work will be done right. I figured I would post this back to the forum so that others picking up their cars take the time to inspect the cars very well at the dealership and also note that things can still fail even after you have inspected it over well.

Kia continues to disappoint me.
I was so looking forward to this moment and firmly believed that it would come true, but the Kia crap here too.
2 months have passed since my application was submitted to the court. This is the deadline for filing a defense (Sunday was the last day). I was so looking forward to this defense, since the answer should be fantastic / bombastic, well, what could you write kia there. But that did not happen. Perhaps the guys from Kia decided not to embarrass themselves.
I have filed a default notice, so I must now get a court order.

by the way, this is once again a reminder to those who are waiting and / or planning that if you have any problems, the kia will simply ignore them. So, think a hundred times whether it's worth it.
