Bad Dealer Dealings - List Your Bad Dealer Experience

Don't bother complaining to Kia Corporate. They are as they say "useless as tits on a bull". They sent me a one line email when I complained ...it said," we are sorry for your issues, but each dealer is independently owned and operated and Kia does not get involved with any legal aspects of the sale". So basically, they are like a drug dealer who will sell you the product. What happens afterwards isn't their problem. They have another customer waiting in the wings. As for taking delivery of another Telluride.....good luck. You will have to pay over MSRP "again" and they will not give you any credit for the $6k you already paid them and lo-ball you on a trade in. Keep what you have, the interior color doesn't matter unless it was purple.

When I ordered the telluride that’s coming in May, it is at msrp and at a local dealership. Hope they don’t price gouge me and maybe recoup some of the market adjustment on the other. We’ll see and I’ll keep you guys posted.

Yep sure did. $6k over. Trying to sell this Telluride because the one we ordered is arriving in a few weeks and has the dune interior we originally wanted. We'll see what I can get for it.
 
If they sold you the first one at $6k over MSRP, do you really believe that they will sell you the second for anything less. Maybe they will be nice and get you for only $5k over MSRP. They got me for $7k over sticker (my decision) and made another $6k in profit after selling my trade in. The dealers are selling less cars and making MORE money than ever. They will go back to offering incentives and negotiating deals after the chip shortages COMPLETELY go away. I'm buying a new 2022 Cadillac and only because the owner is a family friend, I am supposed to get the car at MSRP, which will net them at least 8% profit. If she tries to do a mark up when the car arrives, I will know she's not our friend. Its a $100k + Cadillac and they have ZERO incentives. They don't even have all the parts for the car and will probably have me return at a later date to have them installed.

FYI!!!! It seems Murray kia in southeast PA is changing ownership on 4/25. As of now it looks like they will change from an msrp dealer to a 10,000 mark up dealer. We are hoping that any orders in already, will be honored at msrp but we don't know .

So I know at murray everyone had to put a $500 deposit down. But nothing is in writing about msrp. The closest anyone has Is emails from salesman stating msrp as the sale price. No official documentation
 
If you have an email with MSRP as sale price that is binding as it's to you.

Nothing is binding unless you have a signed agreement. MSRP is Manufacturers SUGGESTED Retail Price. As I said prior, I complained to Kia Corporate and they replied that they do not and will not get involved with selling the vehicles. If you end up getting a different offer, what you end up with is a "civil dispute" that you can go and try and sue in civil court. I am glad to see that Cadillac Division of GM, sent a warning to Cadillac dealers that if they mark up the Cadillac CT5v-Blackwing, they will be punished by GM. They will cut off the dealer allotments of vehicles.
 
A deposit is a binding agreement - if you have a deposit for MSRP and they sell above MSRP my first call would be to the state’s AG office. They take this stuff seriously
 
It's not classified as a "crime". It is classified as a "civil dispute" and will not be investigated by the AG (in NY anyway). There has to be a theft of funds by fraudulent means. Its like buying gasoline at the pump. Yesterday it was $3.95.........today its $4.25. You can either buy it or drive away. If you have a deposit paid, they just need to return your deposit. This also happened with me buying my house. We had an agreed price of "x" dollars. I signed the contract to make the purchase. Just before closing, they decided they wanted more money. Because THEY never signed their side of the contract before the closing, the deal was over. I couldn't do anything about it.
 
Most AGs have a consumer protection division that go after predatory marketing as well as bait and switch tactics. NY does as well.

It’s not like gas prices going up. But if you went to a gas station and put down a deposit for gas on a future under the stipulation of a specific price, then that price would have to be honored.

As for your house, if you gave them a down payment you could have filed a notice of lis pendens and forced the sale. Sounds like you had an absolute s*** attorney. But that would be a private civil matter as you and the seller are private parties, not a business engaged in public commerce under specific laws governing marketing and business practices.

They probably made 5 million. One million dollar fine was the cost of admission.
 
Bottom line...that order at MSRP has no weight. Anyone who ordered form Murray got the short end. Once your car arrives its over MSRP or take back your deposit. As of today my car is there and so is the $7995 over MSRP that they want for it.
 
Just wanted to hop on here and let everyone know not to order from Jerry Seiner Kia in UT (they have two dealership locations). They have been extremely dishonest and the communication on their end has been well below a decent expectation and what they promised.

I placed an order with them 2/4/22 and was quoted 10-12 months. I was promised a monthly text on the 4th each month to update me on the status and answer any questions. I was sent an order form from the dealer of what they would be putting into the system and was told "we do not charge mark-ups for in state customers".

The first month went by and they'd adhered to everything they'd promised - a status update and answered any questions I had at that time.

The next month, I had done more research and found somewhere in this forum in several different threads that Jerry Seiner's wait is so long because they take the majority of their allotted orders each month from out of state customers for marked up prices. I read that they only enter orders into the system when KFOS opens up each month. Other dealers enter your order into their dealer system when they are received and then KFOS accepts the dealers allotted amount each month and you slowly move up the list. Jerry Seiner does not do this. They wait to put any orders into their dealer system until right before KFOS opens up and they pull some insanely low amount of in state orders into that allotment after they have entered in their marked up out of state orders. Essentially, this means people from other states ordering from them paying $5000+ over sticker are getting a car quick, while the rest of us have to wait.

My suspicions were confirmed when I texted my salesperson in month three and asked how many orders they had total, where I was on the list, and how many tellurides they get each month. No response from my salesperson for almost a month. When she replied, she said "so sorry for the delay. I have been out of town. I don't have that information, but I will ask our manager and let you know.' I said thank you and that I would wait to hear back. That was over a month ago. I also did not receive a status update this month on my order.

I have since ordered from a different dealership in Colorado - Arapahoe and had an entirely different experience. I also got an order form showing they submitted my order into their dealer system and it has an order number - something I have still not received from Jerry Seiner over three months after ordering.

You should keep your order to be processed from the original dealer and and keep making polite, short, status requests as if you are an interested customer. get your ride from a different dealer that is fair with you. Then when the original dealer calls to say that your car has arrived, tell them....."never mind".

That may be for the AG, but there are people here and with other brands that will tell you otherwise. Your deposit means nothing unless it's in writing for MSRP. Even with that until you sign and drive away nothing is guaranteed.
 
With a clear incoming slow down in everything, whos excited to watch dealer lots start to backfill as preordered cars arrive and consumers looking at 5k+ markups (likely underwater already) and incoming 5% min apr. I forecast some schadenfreude and I hope these bad actor dealers all go bankrupt. so many poor souls will be underwater in 6 months.
